Vike Posted April 11, 2019 Report Share Posted April 11, 2019 Hi All, I am currently under H1B. I was with employer A with valid Visa approved and stamped till Jan 2020. I94 also reflects Jan 2020. I moved to employer B on Transfer Request Receipt on Feb 2018. Unfortunately Transfer was declined on Nov 2018. Employer B again filed a transfer for a different Project within 60days from the denial and it is under processing. Currently I got an offer from my Previous employer A. Also When I checked my old I797 number of My visa petition filed with employer A before it still shows approved. Considering the fact that I have been working for employer B for more than a year now under Transfer receipt, Can I join employer A on my old Visa? Link to comment
JoeF Posted April 12, 2019 Report Share Posted April 12, 2019 Employer A was required by law to inform USCIS that you no longer work there. This is mandatory. That means the old H1 is revoked. If employer A wants to hire you back they have to file (and pay for) a new H1 petition. Link to comment
