The date on my I-797 is July 1, 2019. 2. My H-1B status expires on 7/1/2019 3. My company has already updated my status with USCIS that I don't work with them any more 4. I laid off on 14th Feb,2019 My question is can I stay in the country after 60 days of grace period. My new company is applying for H1B. Also, Can I go to Canada for stamping instead of India? xTDx Posted March 31, 2019 Report Share Posted March 31, 2019 No stay allowed. You will be accruing unlawful status after 60 days of grace period. Moreover if you got a grace period and you still overstayed, next time consulate and cbp and uscis may not take your decision lightly and not even issue you a visa for other or same classification. Once you are out of us, home country is suggested for stamping but you can go to any country that takes third party nationals for stamping. Link to comment
