H1B Approval; validity for CAP Exempt

All, I am looking for options/suggestion as my case is as below.
1. H1B approved in 2006 Sep till 2009 Sep , but I used for about a year. So ~5 years are remaining on my H1B.
2. L1B - 2010 Sep -2013 Dec stayed in US, Denied the extension.
3. L1A - 2015 Sep -2018 Dec stayed in US, Denied the extension & travelled back. 
Now can I claim #1, H1B extension/amendment under CAP Exempt as I left out with 5Years period? Is there any expiration period?

OR

Is there any cooling period to refile my (#3) L1A - Extension/New ?
