maheshmehra Posted February 12, 2019 Report Share Posted February 12, 2019 The following are my detailsI140 Approved - October 5th 2018H1B Expiration with Visa and I94 with 6 years maxing out- 29th Aug 2019I want to switch jobs, and even though i will wait for the exact 180 days period to complete on 3rd april, so will move to the new employer on 7th or 10th april.However, i will have to initiate the H1B transfer earlier around mid of feb.And the new job is very much different from my current, so the job duties and designation will be a lot different, my I140 was approved as Software developer but i will be moving into product manager or business analyst role.So my question is1. Can my new employer initiate a h1b transfer before I complete the 180 days to I140 with my current employer, and still get a H1 approved for greater than 6 years max out date with an approved I140 from previous employer.2. Is it safe to switch exactly after 180 days is complete, or there is a reason for us to wait a little longer. 3. Does having very different Job role for the new job as against the one with which the I140 is approved cause H1B denial issue Quote Link to comment

User099 Posted December 17, 2019 Report Share Posted December 17, 2019 Its mandatory for the employer to not withdraw the I140 for atleast 180 days after approval for you to use it later. Now do you have to work for the employer to do that is something you and your Employer should decide. Quote Link to comment
