cskchimpu Posted January 17, 2019 Report Share Posted January 17, 2019 Hi, I came to US in 2017 through Employer A and my I797 has got validity till 30th Aug 2019, and same date is available in I94 too. In 2018 August, Employer B initiated H1B transfer and it has got denial on December 26th 2018. (as per date on denial letter) Meanwhile Employer A has revoked status on 6th December 2018. My question is till what time i can stay in US, since i do not have any status now. (Employer B is not ready to do MTR) and when should i leave country. can i initiate H1B transfer now with any new employer and stay in US? FYI: currently my I94 has date till 30th August 2019 Link to comment
Provence Posted January 17, 2019 Report Share Posted January 17, 2019 With a revoked petition from Emp A and a denial with Emp B, you best bet would be to leave the US. Clearly Emp B's documentation was sub-par. You have 60 days from the December 6 revocation, which is coming up soon. Exit the US, and either try to obtain a new H1b from your home country, or work overseas. Link to comment
