chandrut
My current H1b visa is stamped until mid of 2019. My employer filed amendment to my H1B visa few months ago and right now it has an RFE as per USCIS website. I am yet to receive details of RFE, my question is can I travel to India at this time and come back into USA with my current stamped visa. Link to comment
xTDx
Yes you can. You need 2 things: 1- Travel documents - Passport and valid visa 2- Valid job . Provable by valid i797. Link to comment
chandrut
When you say valid job provable by valid i-797, does that mean i need to have an approved i-797 for my new job ( for which amendment is filed and got RFE) ? i have approved i-797 for my last job, not for current job. You can only reenter with an approved H1 for the current job. Link to comment
