RajanM Posted November 30, 2018 Report Share Posted November 30, 2018 EB3 – Employer A : I140 Filed by my employer A and approved on June 8,2011 with the priority date of May 6, 2010. EB2 – Employer B : I140 Filed by my employer B and approved on October 11,2013 with porting the same priority date of May 6, 2010. Now I am working for Employer C and did not restart my GC process as I was told that I can use the approved I-140 from my previous employer to file my I-485 when my priority date become current. I checked the status of both I-140 on USCIS case status and they both are active. My question is, can I use either of the I-140 petition to file my i-485 when my priority date becomes current or should I start a new petition with my current employer. Appreciate your response. JoeF Posted November 30, 2018 Report Share Posted November 30, 2018 AnI-140 is specific to the employer who filed it. It can NEVER be used by another employer. The only thing that can be reused from an old I-140 is the PD. Link to comment
