Soni2
Hi, I noticed that the offered wage in my labor form is different than my current pay. I heard one of the pod cast some time back about this topic where it was mentioned that employers offer based on prevailing wage, but they only need to pay that when EAD/GC is approved. My question is that, do employer have to pay offered wage in Labor form when EAD/GC is approved. if yes, when? 1. when EAD approves? 2. when GC is approved? Can employer deny to match to offered wage? can they delay to implement it after EAD/GC (whatever is the law)? Thanks! Quote Link to comment
Attorney_17
Correct, the prevailing or offered wage does not need to be paid until the time the green card is approved. Quote Link to comment
