I have completed 5 yr and 1 month on H1B in USA and came back to India last year due to H1B extension denial. I have an approved I 140 since May 2015, which makes my case as cap exempt. Also have about 11 months unconsumed from 6 yrs of H1B. So question is can we apply for H1B in premium processing? Thanks for your guidance. Regards, Ayaan Link to comment

NotAnAttorney Posted September 19, 2018 Report Share Posted September 19, 2018 Nope. Currently only H1B extensions with same employers and H1B petitions from cap exempt employers ( Higher education non profits) are the only categories that could avail premium processing. Link to comment
