Minu Posted August 28, 2018 Report Share Posted August 28, 2018 I am working on L1 A and I have completed 4 years of work in US on L1A Visa in a MNC. I am continuing in US on L1A visa which is valid till 2019 Aug and it can be extended till 2021.Can EB1 green card process be initiated for me as I have completed 3 years in US on L1 A visa. I have read in the website ("http://www.immi-usa.com/eb1c-green-card/" ) which states as below: "This is because one of the requirements for the EB-1C is that you must have worked at the multinational company’s foreign branch for at least one year in the three years leading up to the EB-1C petition. If you have spent the last three to seven years in the U.S. under L-1A status, you will be ineligible for an EB-1C until you travel back to your home country and work for the foreign branch for at least a year. " Is there any legal way, in which I can apply for Eb1C in this situation? Link to comment
Narendra T Posted October 9, 2018 Report Share Posted October 9, 2018 1 year rule in foreign nation is applicable only for initial L1 A visa application. Even for visa extension in 5th year, they have this rule. Link to comment
