I am in H1B and I have my I140 approved and its more than 180 days. I have completed my 5 years in H1B. If I transfer/switch my H1B to new employer, can the new employer file my transfer petition using my approved I 140 and request 3 years extension. Since I have not completed my 6 years will I receive 3 years if my transfer is approved or will I receive only the time period left in my H1B. Link to comment

mehopeful Posted July 2, 2018 Report Share Posted July 2, 2018 Your employer can certainly request the full 3 years. It is however the maximum that they can approve. It can be shortened because of project duration etc. Link to comment
