I-140 filed with 3 months gap between jobs

Hello all,

I filed for I140. I got the experience letter from my previous employer but there is about a 3 month gap between what the letter says and when I found my current job.

Has anyone been in this situation? did you get the i140 approved or did you have to do anything else? any responses will be appreciated.

GC is for future employment even if you are currently employed by your petitioner so the 3 month gap should not be an issue on I-140 stage.

uscis will check if you have maintained proper status during I-485, you will need to provide documentation (if asked) about your status during that period. check 245k, you are allowed 180 days of out of status for I-485 AOS process.
