I-94 Expired on April 2011 and Valid I-797 until March 8 2012

Hi All,

I have entered into US with Previous Employer XXX on July 2009 and AT POE I showed my current employer I-797(will be expire on Mar 2012)but i got I-94 with date April 2011 ie previous employer I-797 expire date.And I moved to current employer YYY on Aug 03 2009(I-797 valid from 05/13/2009 to 03/08/2012).I started to work with current employer since Aug 03 2009 to Present.My I-94 was expired on April 2011 but i have valid I-797 until March 2012.My Employer about file H1-B extension.

Can i get new I-94 without leave from US?.

Can i stay in US with out leave or do i need to leave and re-entry to get a new I-94?.

Am I out of Status on my current H1B which will be expire on March 2012?.

Please let me know.

I have noticed that my current employer I-797 has

I-94(attached in I-797) it shows valid from 05/13/2009 until 03/08/2012.

you may not be out of status depending on if you have a new I94 attached to the I797 when you received the new approval.

If you do not have a new I94, then you have overstayed by a lot.

Hi,

Charlotte CBP is denied to correct the I-94 Date.He said that to take a appointment with citizenship and immigration.My Employer advised to go IAD POE due to my POE is Washington, DC.I requested to go through attorney. He wants to try IAD CBP.

Attorney said that I have to go out from US and come back with stamping on or before OCT 10 Ie before 180 days from I-94 expired date(Apr/12/2011) so I have decided to go out and come back with visa & I-94 at chennai embassy in India.Please let me know if some other alternate way before leave this country.

CBP office doesn't correct if you have valid I-94 issued by USCIS. Please make a appointment with USCIS before go out from US.

I-485 will get rejected if you leave from US without solve this issue with in US.
