raheel.mohd Posted May 23, 2018 Report Share Posted May 23, 2018 Hi, My I94 is valid till Sep 23rd 2019 (Approved H1B petition and stamped from employer A), then I had changed employer from A to B and later returned back to employer "A". Employer "A" filed for H1B Transfer (from B to A) request and got RFE. If any case my transfer gets rejected, Can i stay back in US until my I94 validity or not? Or do I need to leave US? If Yes, how soon? What are the options available for me so that I can stay back in USA even if H1 transfer gets rejected? Link to comment
JoeF Posted May 24, 2018 Report Share Posted May 24, 2018 Did employer A inform USCIS that you weren't working there? If not, did they pay you for the time you were not working there? If an employer doesn't inform USCIS, then the person was still an employee and needed to get paid. Link to comment
