Vama23 Posted May 11, 2018 Report Share Posted May 11, 2018 I am currently in my 6th year H1b which is expiring in 8 months i.e till 01/03/2019 and my current company has filed my PERM application in January 2018 A very good job opportunity has come my way and they are ready to transfer my h1 . I want to switch to that company and am not sure what to tell their Immigration lawyers since currently my PERM is pending and my H1 is valid for 8 months 1. Should i go ahead and tell the new company to file my h1 b transfer since it will be filed in regular processing ( premiere processing is suspended till sept) and meantime my PERM gets approved and i 140 is filed in premium (IDEAL situation) is there something i can do without jeopardizing my immigration status and joining new job? V S Posted May 15, 2018 Report Share Posted May 15, 2018 Premium process suspended only for the new H1 petitions filed this year not for existing H1b’s. Also , priority date will be locked only 6 months after I 140 approval. With in 6 months company may revoke it. Link to comment
