I am out of my max period and I Filed my H1B Extension Jan 2018, got RFE, not got denied. My Current Visa Valid till June 16th 2018.(valid I 94). I have approved 140 . What are my options ? 1. Can i appeal against the decision, with current employer. ? 2. in another 45 days , Can i change my employer and transfer my H1b and file the extention within the period? Link to comment
satya2k1 Posted April 24, 2018 Report Share Posted April 24, 2018 You cannot file an appeal, because H1B is employer's petition. if I were you, I would change the employer immediately and apply for H1B extension with correct and appropriate documents. There are 3 major things that might be reason for denial in your case: 1. Specialty occupation - Make sure that your job at new employer is a specialty occupation, any positions with Analyst or Programmer titles are NOT specialty occupations. 2. Wages - Make sure that you are getting atleast Level 2 wages 3. Employer-Employee relationship - Make sure you get a client letter for H1B petition. By checking these major things, you will get H1B extension. Link to comment
