H1B Extension Denied

Hi All,

Requesting to reply this post ASAP.

I am out of my max period and I Filed my H1B Extension Jan 2018, got RFE,  not got denied.

My Current Visa Valid till June 16th 2018.(valid I 94).

I have approved 140 .

What are my options ?

1. Can i appeal against the decision, with current employer. ?

2. in another 45 days , Can i change my employer and  transfer my H1b and file the extention within the period?

You cannot file an appeal, because H1B is employer's petition. 

if I were you, I would change the employer immediately and apply for H1B extension with correct and appropriate documents.

There are 3 major things that might be reason for denial in your case:

1. Specialty occupation - Make sure that your job at new employer is a specialty occupation, any positions with Analyst or Programmer titles are NOT specialty occupations.

2. Wages - Make sure that you are getting atleast Level 2 wages

3. Employer-Employee relationship - Make sure you get a client letter for H1B petition.

By checking these major things, you will get H1B extension.
