kng85 Posted April 2, 2018 Report Share Posted April 2, 2018 Hello, I'm in the 6th year of my H-1B visa with the same employer. Employer had qualified US applicants when the job was posted with 1 year experience requirement. PERM has not been filed. Employer is willing to redo the PERM with a new job description for a senior position within the company. My wife is a J-1 physician. If I move to J-2 dependant status and apply for EAD, I can continue working with the current employer. It seems like the J-2 visa will be approved before the EAD comes through. Can I continue working on existing H-1B, between when the J-2 visa is approved and the EAD comes through? Please let me know. Thanks in advance. Link to comment
JoeF Posted April 2, 2018 Report Share Posted April 2, 2018 When the J2 is approved, you are no longer on H1, and you have to stop working until the EAD is approved. Link to comment
