H-1B Amendment RFE

Hi Everyone,

I work for a MNC and base location is in TX but sometimes we go to the Client locations. My company files LCA and Amendment when we go to the Client location. Recently I went to a client and LCA/Amendment was filed but received an RFE for that petition now. I worked there for only 3 weeks and I am back at my Base location. I asked my company lawyer to withdraw the petition as I don't work there anymore but they are against it and are telling HR that I would be out of status if I don't respond. I have an approved I797 from the base location expiring in 2022 and I am currently working from this office.  My understanding is even if amendment gets  withdrawn or denied , I won't be Out of status as I already have an approved petition and I am not physically working at the location where LCA/amendment was filed.

If anyone was has been in the same boat or has any info, please pitch in. Any comments/help on this will be appreciated. Thanks

1. Yes if its denied you won't be Out of status as you are working at base location per an already approved petition.

2. They may need to respond with the facts.
