Hema Reddy Posted February 15, 2018 Report Share Posted February 15, 2018 Hi all, It is been 167 days since my I-94 is expired and my H1-B decision is pending. We already made my case premium, but I got RFE this morning. My attorney is saying that she will respond to the RFE by end of next week. In this case, my decision will not come out within 180 days period (after I-94 expiry). What should I do now? Can I stay beyond 180 days, or should I go back to India and come back after the approval? Please suggest. Link to comment
kittu1only Posted February 19, 2018 Report Share Posted February 19, 2018 Hello, You can work for 240 days beyond your I94 expiry date. For example if your VISA or I-94 expired on Nov 15th 2017, from that date you are eligible to work for 240 days. Link to comment
