RiaT Posted February 6, 2018 Report Share Posted February 6, 2018 Hello all, I applied for my H1 transfer from employer A to B and USCIS received my application (premium processing) from the lawyers on Dec 7, 2017 and an RFE was received for Specialty occupation on Dec 20, 2017. The lawyers submitted a detailed response on Jan 24, 2018. The 15 calendar day cycle ends tomorrow on 2/7/2018 but I inquired with the lawyer and she said USCIS not responding sooner is a bad sign and there are chances the petition will be denied. Is this true? I thought people still got approvals on 15th day of PP. Please help! Quote Link to comment
NotAnAttorney Posted February 7, 2018 Report Share Posted February 7, 2018 Yes, just keep waiting until the last minute of 15th calendar day. Also, if they were not able to decide within these 15 days, it doesn't mean its a denial, it just means that they are still working on your case and USCIS usually refunds the premium processing fee, if they were not able to provide a decision with in 15 calendar days.
