amarghosh Posted February 6, 2018 Report Share Posted February 6, 2018 Hi Team , Need some help, I am currently in H1B which is valid till Oct 2020 also got my I140 approved in March 2017 If i change my job, does my new employer need to file my Labor-Perm and I140 again so that my visa can be renewed after 2020 ?? As i was told that if I140 is more then 6 months new employer do not need to file a new one unless there is a change from Eb3 to EB2 Appreciated your quick response Link to comment

If you plan to work for a new employer till you get your GC, this employer needs to do PERM processing from ground up, just like your current employer. Your already approved I-140 can be used by your current and potential employers to file for 3 year H1B extensions. Link to comment
NotAnAttorney Posted February 6, 2018 Report Share Posted February 6, 2018 Per current law, new employer could file extension based on your old approved i-140. You can do this only until your priority date is current. If your PD becomes current, your old petition will not help. You should by then have an approved 140 from your then current employer.
