Ayaan84 Posted January 16, 2018 Report Share Posted January 16, 2018 Hello All, I wanted to know your opinion on responding to RFE Vs withdrawal of amendment petition. My H1B extension beyond 6 yrs was recently rejected and I came back to India. We will be filing a new H1B soon. Meanwhile, there was one amendment filed for me which has received the RFE. This was filed after my original beyond 6 yrs extension petition, which got denied as mentioned above. My confusion is since I am no longer in US on active H1B, Do we really need to respond to that RFE. This was an amendment petition to update my client details while I was in US. I want to avoid another rejection/rfe before we file the new H1B. Our lawyers are of opinion that we should respond to RFE even if I am no more on that project and in US. They suggest that withdrawal might cause issues in future for my Green card processing (AOS process). I have my I 140 approved since 2016. Please let me know your opinion. Thanks in advance.
