H1 extension beyond 6 years using withdrawn I140

Hello,

My I140 with employer A approved on jan-2015. I stayed with emp A until Aug-2016 and i moved to Emp B and i got H1 extension until 02-2018.

Emp A requested my I140 withdrawal on dec 18th 2016 and he received notice from USCIS on sep-2017.

Can i apply for H1 extension (my 6 years period is already over) with Emp B on withdrawn I140.

PS: My company attorney is saying that i can't apply for H1 extension because Emp A withdrawn my I140 before 01/17/17.

Can any one has more information on this issue?

Hi rajendra444,

Can you please provide an update? Was your employer able to file H1 extension with an I-140 that was withdrawn?

I am thinking to change my employer but I think they will withdraw my I-140 if I leave them.
