LCA and H1B amendment for H1B Remote work in a different state

Recommended Posts

I have a situation where my current employer has filed LCA for an inhouse project in one state "X". Now i got another project for a different client where the work can be done remotely. So my employer did not file an LCA or H1B amendment as i can work from the same state "X".

Whereas i have some friends and relatives in another state "Y", so i wanted to do remote work from state "Y". So what can i do in this case ? Can i relocate to state "Y" and  ask my employer to file LCA and H1B amendment for the home address where my friends reside in state "Y" ? Will it cause any issue in future during H1B extension process?

Hello,

Are there any updates on your case? I am in similar boat - though I had to start working for a different client in another state, they let me wor k remotely from my state only. My employer filed for an Amendment, but now says we do not need it since I am working from the original state/MSA for which I already have an approved H1B.
