lcm86 Posted September 19, 2017 Report Posted September 19, 2017 Currently, I am in the US on a F2 VISA and by October 1st, 2017 I will be an H4. My husband's company have never filed the petition for an immigrant visa (green card). I had an H1B approved on 2015 (2016 fiscal year), which I only used for 1 month because I was laid off. I filed a change of status to F2 before the last day of employment and it was approved. The H1B was never stamped. Now another employer is offering me a position. Is it possible for a new employer to activate my old H1B? If so, what is the procedure and how much time will it take? Also, while in the process of activating, is there any possibility to travel abroad?
JoeF Posted September 19, 2017 Report Posted September 19, 2017 If you have worked on H1 in the last 6 years and ha e been counted for the quota, an employer can file a new H1 petition for you at any time, cap-exempt.
