H1bWorker Posted August 31, 2017 Report Share Posted August 31, 2017 Hi, I am on H1b cap exempt. I wanted to approach my employer to start the green card process. Before I do that, would like to get some questions answered. 1) Can my employer apply for Perm and there after I-40 (just like the process is for non-exempt h1b) ? 2) If they do and after I get my I-140, can I / if I switch to a non-profit employer, would they need to re-apply for H1b in the non-cap-exempt bracket? Or will it be a normal extension until my priority date becomes current? Thank you very much for your advise! Link to comment
JoeF Posted August 31, 2017 Report Share Posted August 31, 2017 The GC process is the same for everybody. There is no special rules for people on cap-exempt H1s. Also, an extension or transfer is really just a new H1 petition. Link to comment
