Could you please spare a minute to read the below & answer my questions as i am in a very tricky situation. *******************Category: EB2 Current H1B Validity: 05/14/2018 (Includes 7th year extension based on approved PERM) Education: B.Sc. + MCA Experience: 13.5 Total (7.5 before joining Cxx) ******************* PERM Filed: 10/23/2013 (Priority Date) PERM Approved: 03/26/2015 I-140 Filed: 09/14/2015 (Regular Filing) 1st RFE Received: 02/06/2016 (RFE on Previous Employer Experience Letter) 1st RFE Responded: 05/02/2016 2nd RFE / NOID Received: 03/03/2017 (Reason: Education - M.C.A. equivalency to US Masters Degree) 2nd RFE / NOID Responded: 04/05/2017 ******************* Could you please let me know: 1) What are the chances of my i140 getting approved in this scenario? 2) Would converting to Premium processing at this stage be Risky? (If Denied i might not get 8th year extension. If pending i might be able to get 8th year extension in few more months) 3) Based on current timelines (4 months at TSC has passed now) – when do you think there could be a decision on my case? Is it a matter of few more weeks (or) Can it go to several months. 4) Having only 9 more months on H1B & further extensions may not be possible if i140 Denied - Is it advisable to switch to another employer at this time & start new PERM (or) keep hopes if this 140 would get approved? 5) If i do H1B Transfer to new employer at this time, how long will the the new Petition be valid until? Option1: Only until current H1B Validity (05/14/2018) Option2: Will i be able to get one full year extension (08/2018) based on approved PERM & pending i140 Option3: Will i be able to get until 05/2019 (current petition + one additional year based on approved PERM & pending i140 Really appreciate your inputs at this time as i am in a worried state.
