Cap Exempt with 5 years Gap!

Hi Folks,

I worked in USA for 1.5 years from Jun 2010 to Feb 2012 and later I moved to India and still working.

Now, in my case AM I CAP EXEMPT?

There is 5 years of gap since I left USA, so will I be considered as CAP EXEMPT?

If yes, then what is the right way to approach for H1B visa Employer?

So please share your valuable thoughts as I am planning to apply by year end.

Yes, you are cap exempt. To be a cap exempt the candidate should had been in H1 status with in last 6 years

You mean to say that I have only one year time left to avail in H1B Cap Exempt criteria? or else am I missing something?
