Generally, if you are currently in H1B status and a new employer files a H1B change of employer petition, you can begin working for the new employer once the Receipt Notice is received. If the petition is subsequently denied, you must stop working for that employer immediately. In that case, it may be possible to return to the original H1B employer if the I-94 is still valid and the company did not revoke the approved H1B petition. Depending on the reason for the denial and whether your current I-94 is expired, there could be potential unlawful presence issues as well.

Because of this uncertainty, many H1B workers will file via Premium Processing and/or wait until the change of employer petition is approved before changing jobs.
