metroguy
Hi All, This is Naveen living in Nebraska state. I have a quick question regarding "Converting H1 To H4+EAD with Spouse H1B and I140 already approved". I have my H1B valid till September 2017 and my spouse is valid till Dec 2018. I am into consulting business and I would like to convert to H4+EAD filing together using Change of status. When I look at USCIS site below, I am seeing the following information that I need to file at Phoenix location. So my question is for H1 to H4 and EAD, is the process quick (2-3 months) or will it take 6-8 months as mentioned in USCIS site for california and other centers for Change of status applications. USCIS site doesn't say processing time for Phoenix center. https://www.uscis.gov/working-united-states/temporary-workers/employment-authorization-certain-h-4-dependent-spouses https://www.uscis.gov/i-765-addresses Together with Form I-539 seeking a change to or extension of H-4 status The Lockbox address found on our Direct Filing Addresses for Form I-765 Web page. H-4 spouse of an H-1B nonimmigrant, and the receipt number of your H-1B principal spouse’s most recent Form I-797 Notice of Approval for Form I-129 begins with WAC USCIS Phoenix Lockbox For U.S. Postal Service (USPS) First-Class and Priority Mail Express deliveries: USCIS Attn: H4 P.O. rohang
it will not be quick, h1->H4 conversion itself will take long time. Faster way will be go out and come back with H4 stamped. and then apply for H4EAD, atleast this will reduce the first half of the process. Link to comment
adshah84
H4 EAD is taking 1 - 1 and 1/2 month at Phoenix but H1b to H4 COS could take longer. If you want to save time you can exit the country and come back on H4 and apply for H4 EAD. Link to comment
