Madhuuk09 Posted January 16, 2017 Report Share Posted January 16, 2017 Hi, i came to US on H4 visa and Since there was an immediate requirements at client location my company filed L1A individual visa on Nov 15th in premium, before 9 days of my H4 expiration(Nov 24th 2016). My visa got denied on Jan 12th 2017 and don't have any valid visa as my H4 is already expired. Due to immediate requirement at client location can I apply for L1B individual now immediately after knowing denial message and continue staying in US. Attorney_15 Posted January 25, 2017 Report Share Posted January 25, 2017 With the expiration of an I-94 card and the denial of a petition requesting a change of status, there is no longer any lawful basis to remain in the USA. At this point, you would normally be unlawfully present and subject to removal from the U.S. You may want to speak with an attorney for specific legal advice. Link to comment
