Baa Posted January 15, 2017 Report Share Posted January 15, 2017 I have a I 140 approved since Sep 2010 under EB2 category and I am moving to new role within my current company . the new role has different set of responsibilities than my current role but my qualifications matches to perform those duties. Would my employer have to file for new I140.. .? I also see this new rule to be in action from Jan 2017 https://www.uscis.gov/news/news-releases/uscis-publishes-final-rule-certain-employment-based-immigrant-and-nonimmigrant-visa-programs Would the implementation of this new rule allow me to move to the new role without requiring a new filing for I140 ? Ricky27 Posted January 18, 2017 Report Share Posted January 18, 2017 Hi, Yes. If your job role fits in the same category as that in your previous employment, then you don't need to start with new PERM process. When your PD dates become current, you need fill form J along with 765. Link to comment
