classicdev Posted December 7, 2016 Report Posted December 7, 2016 Hi, I would like to know if an OPT EAD person who is just out of collage, can work as an independent contractor on 1099 for a company? If yes, while filing for taxes, what would the procedure be to get a 1099? Thanks.
JoeF Posted December 7, 2016 Report Posted December 7, 2016 That is possible, as long as the work is in the field of study. You write invoices, and the company pays them. At the end of the year, they give you the form 1099Misc. You use that for your taxes, you have to fill out Schedule C as part of the 1040. You may want to use business tax software or get a CPA to prepare your taxes. Depending on how much money is involved, you also may have to file estimated taxes quarterly.

On STEM OPT, the company has to be enrolled in e-Verify. If you are working on 1099, you are self-employed, i.e., you are working for your own one-person company. So you would have to enroll your one-person company in e-Verify.
