chirag007
6month back I changed jobs after being in H1B for 6years and I was able to file H1B transfer based on approved I-140 from previous employer. I am planning to file my H1B extension with new employer now and I understand if my I-140 is still approved/valid, I should be able to extend my H1B beyond 7years again. My question is: What happens if my old employer now cancels/revokes my I-140. They have not done it in last 6 months but I get very tensed thinking what happens if they do before I file my extension as my current employer? What is with this new I140 rule to be made effective Jan-17. Can that save me? Link to comment
Attorney_15
As the new rule is not effective yet, an I-140 revoked now by the employer is not valid for extending H1B status. Link to comment
