Bhar2016
Hi I am an Indian on h1b extension and have my I140 approved with Jan 2014 priority date. My fiancée is a green card holder living here for 15 yrs and holds Pakistani passport. My questions are, Once we get married: 1. do I need to change to family based visa myself? 2. or should I let my company know so that they can process as employment bases per the spouse' nationality 2. What is the priority for Pakistan though I understand countries other than China, India, ?phillipines and Mexico have better dates? 3. Are there any issues with Pakistani passport holders for GC processing? Pls may suggest. I live in Houston. regards Link to comment
JoeF
You can, but don't have to change to a family-based GC process. It may be faster, though. You can't use cross-chargeability for your employment-based application, because your future spouse already has a GC. Link to comment
Bhar2016
Joe Thanks for your prompt reply. What if she gets US citizenship which we are expecting in Jan 2017? Can I use the cross chargeability then? Link to comment
JoeF
There is no quota for spouses of US citizens, so cross-chargeability wouldn't even matter then. Link to comment
