H1B---H4---here vs India

I Stayed back in the US even after losing job while on H1B.(I know that was a bad decision) Now going back to India in few weeks. Fiancee is here on H1B for last 2 years and we are planning on getting married soon.

We are open to both options( marriage is a must):

1. I come back as dependent on her H1B

2. She comes back home with him if H4 is denied.

Since we prefer option-1, I want to ask what will increase my chances of getting H4...

a) civil marriage here and then going back to India so paper work can start

b) Marrying in dec-2011 when she is gonna visit India and applying for H4 then.

c) any other option/advice
