Which should be filed? - Re-Entry Permit or Advance Parole

Hi,

Can Murthy Forum members please advise on whether i should apply for re-entry permit or advance parole.

I entered US on F1 visa, and then been working on cpt and opt.

My opt ended april 15 2011. and my company filed for my h1 which is approved until april 2012.

I last entered US on student visa, so i do not have my h1 visa stamped yet.

My Fiancee is US Citizen and we are planning to get married in USA at the end of August and then file

I-130, I-485, I-765, I-131 in first week of september for my AOS and GreenCard.

I want to go to India for my sister's marriage on Dec 25th

I am in dilemma to figure out which option should i select, as i beleive my application for AOS will still be in process by the time i want to go to India.

I will appreciate if someone can help with this questions:

1) Does re-entry permit approval, means my AOS application will not be abondoned if i travel abroad.

2) I want to avoid going for H1b stamping in India. so what should i apply Re-entry permit or Advance Parole.

3) depending on question 2, Do i need still need to go for Visa stamping?

A reentry permit is for somebody who already has a GC.

For somebody with a pending I-485, you need Advance Parole in hand before leaving, otherwise, the I-485 is considered abandoned.

AP uses the same form as the reentry permit, I-131.

Also if i would file for AP, and get it approved before i leave for India.

I do not have to go for H1b visa stamping. And i will be allowed to enter US on my approved h1b document and the AP.
