I got arrested in Texas for suspicion of public intoxication last month and I'm positive that the case would be dismissed soon as I was not guilty. I plan to travel to India this December after 3 long years to get a visa stamp. I realize that I would have to check yes on DS-160 when asked about arrest and I plan to be upfront about it. What consequences am I looking at? What are the odds of getting a 221g? I read they might ask me to do medical screening to check for alcohol dependence or abuse. Is it possible to take this test before the interview? Approximately, how much of a delay am I looking at for getting back to the US? I believe I will not be able to get a leave of more than 8 weeks maximum and can't afford to get stuck in India. Or should I just delay my travel plans?
