Approved I-140, Extension Filed, H1 Transfer to New Employer

Dear All,

 

I have the Approved I-140 from Employer A. Employer A has filed extension based on that now. My 6 years on H1 just got over.

 

In this situation, can I find a new employer and do H1 Transfer immediately?

 

Will USCIS raise any issue stating that already one request is pending from Employer A and I cannot change employer now by doing H1 Transfer which would be a second request to them?

It is fine to transfer to new employer and file extension with current employer. you get to choose which employer to work for irrespective of their petition effective dates. You cannot work for the both the employers at the same time and once you start working for the new employer (for example), you cannot just like that come back to work for the old employer if you decide to change your mind.
