Can H4 can go for VISA stamping on expired Primary Petetion ?.

I have a situation here and need some help on how to proceed further on this.

 

My Petition/VISA/I94 (all have same expiry dates) is going to expire on Aug 1st 2016.

I am applying for VISA EXTENSION through premium processing now.

 

I am planning bring my spouse to US.

 

The problem here is getting the VISA Interview Slot in India(Hyderabd, right now the available slot is available in Sep second week)

 

What is the best way so that i can bring my spouse to US at the earliest ?..

 

Please advise which option i have..

if it is urgent for you to get her here, did you try to see if there are any availability for visa appointments at other locations in india...?

Either before the current petition expires or after the new one is approved.

In Hyd and chennai , the waiting time is around 2 and half months.

In other place like New Delhi and Kalcutta waiting time is 1 month.

 

But i am not positive on going to a different embassy and getting stamping there. As you will get teh question like why you are coming to a different embassy when you have a near one. So not sure whether they will approve or not. Little worried about this point.

You need to take decision based on your need of urgency...
