hitsandeep
Hello, I have a question regarding travelling to Home country India and coming back to US. My Scenario 1) My Current H1-B Visa expires on 31st December 2014 2) I have a new Valid I-797 until 31st December 2017 3) My Last Visa Stamping was in Toronto, Canada in January 2014 I wanted to take a vacation(marriage) in December 2014, to travel to India, and My question is, can I travel back to USA in between December 24-30th 2014( Since my visa is expiring on December 31st 2014)? Is there a deadline that I should travel back before ‘n’ no.of dates before visa expiry even if I have a valid i-797? Thanks for your reply in advance. Link to comment
jairichi
No specific deadline. If I was you I will travel as early as possible rather than wait for a day before H1B visa expiry. Link to comment
pontevecchio
You can. But you can also get a new visa. Link to comment

Did you came across anyone doing so? @pontevecchio I am planning for Stamping in Last week of November, if i can get '2' appointments dates....which i can only find out untill Nov 2nd week.... i was wondering if i can skip the stamping and just send my spouse for H4 with new I797 Link to comment

pontevecchio
Whichever works. Send her alone or go together. If you are working for a regular company there is no problem. Link to comment
