jobas2007 Posted August 25, 2012 Report Share Posted August 25, 2012 I have completed 6 years on my H-1 and have got extension till year 2013 based on approved I-140 with current company - say Company A. If at this stage, suppose I go for an H-1b transfer to a new company - Say Company B (who may be willing be sponsor GC), will i get the new validity date (post H-1 B transfer of "new" H-1b) of 3 years (say till 2014 - 2015) OR I will still get the H-1b till 2013 only, because the Company B is yet to start GC? And once I get I-140 approved from Company B , I will be able to get 3 year H-1b extensions subsequnetly. Appreciate any help on this. Link to comment
pontevecchio Posted August 26, 2012 Report Share Posted August 26, 2012 No period in H1 status can be more than 3 years at a time. Assuming the I-140 is not revoked you will be able to get a 3 year extension from now. Link to comment
