H1-B Transfer..need your input..

I applied for H1-B visa with Company A, got approved and the start date is October. I haven't used my H1-B visa. I am still on my OPT until October. Meanwhile i got an offer from another companyB.

Can i transfer to Company B directly from company A eventhough i didn't use my visa with Company A.?

Is there any restriction that if i apply for H1-B visa with company A i have to be with that company for certain period of time before my transfer?

B can file a H1 petition for you. Tell them the facts and they will handle it.

there is nothing like transfer its always a new petition and since you previous was approved you were counted towards the cap so this petition might be cap exempt. please contact a qualified immigration attorney and they will take care of it.
