H1B Transfer RFE requiring paystubs and W2s ?

Hi,

I have applied for H1b Transfer through a new employer in August. I received a RFE requesting for paystubs since I wasn't able to get it from my previous employer at the time of the Application. I have them now (for the previous 2 months before joining the new employer). What I wanted to know is the USCIS has also asked for all my previous W2's for all years on H1B visa, which is 07, 08, 09, and 10. I have all the copies of previous W2s and thats not the issue.., but I need to know what the reason is behind this request. The RFE states that they need to make sure that I have been on valid H1B status all throughout these years on H1. how does that relate to W2? Is there something I need to know?

They are probably checking up on your former employer. Send the required docs for the RFE and you will get approval.

It's simple, your previous W2's will reflect your annual income, which should be at least equal to what's mentioned on your LCA pursuant to your H1-B filing. If that's not the case even for a single year, then it would mean you were not paid all time and hence your H1-B status is not valid.

I thought you had to submit your w2 with your H1b application. But yes, as mentioned by earlier respondents they are just checking if you were in valid h1b status.

If income is less than LCA for some valid reason (out of US period, genuine documented unpaid leave), send that as well with a cover letter explaining everything.
