I received a RFE requesting for paystubs since I wasn't able to get it from my previous employer at the time of the Application. I have them now (for the previous 2 months before joining the new employer). What I wanted to know is the USCIS has also asked for all my previous W2's for all years on H1B visa, which is 07, 08, 09, and 10. I have all the copies of previous W2s and thats not the issue.., but I need to know what the reason is behind this request. The RFE states that they need to make sure that I have been on valid H1B status all throughout these years on H1. how does that relate to W2? Is there something I need to know? Link to comment

H1B-eeker Posted November 15, 2011 Report Share Posted November 15, 2011 It's simple, your previous W2's will reflect your annual income, which should be at least equal to what's mentioned on your LCA pursuant to your H1-B filing. If that's not the case even for a single year, then it would mean you were not paid all time and hence your H1-B status is not valid. Link to comment
