Attorney_21 Posted November 2, 2011 Report Share Posted November 2, 2011 dgandhi: If more than 180 days have elapsed since the filing of your I-485, the employer's withdrawal of the approved I-140 should not negatively affect you, based on the relevant USCIS memoranda. Also, filing of an AC21 letter is not required by any law or regulation - it is a good practice however, and is strongly recommended. Link to comment
