Now both the employer wants to file the H1B petitions , so is it legal to file 2 H1B applications for the same employee. Can USCIS keep the track of these two applications for the same employee. if both the petitions are approved , then how can I handle the visa stamping process as I have two approval. gopalakrishnach Posted May 13, 2021 Report Share Posted May 13, 2021 You can have multiple petitions applied at same time and it is legal. You need to decide which one you will join. The other company will let USCIS know that you do not work for them and get the approved H1B petition revoked. Thats law. Quote Link to comment
