Questions2021
Friend on h1b got laid off. What are options available to continue in USA apart from searching another employer? Can status be converted to b1? Is 60 days grace period there? When does it start exactly? Visa is valid till i94 validity correct, whether employer revokes h1 or not? Please pour your advise. Zodiac System
Friend can try options of going on H4 or B2 visa before 60 days or I94 expiry, which ever is earlier. 60 days starts from day of layoff. Employer withdrawing his H1b approval will not affect him. Quote Link to comment
LeaveMessageH1B
60 days start from date of lay off (last day of work) and not form last paycheck date. Visa is just to enter US, once your "friend" is laid off he/she is no longer working for particular employer, and by law employer is supposed to notify USCIS about termination of employee-employer relationship and withdraw petition. So in given case i-94 validity does not serve any purpose as same can not be used to enter US. Quote Link to comment
