I never traveled to the States on H1B and it's expired since 2014 (as per visa) Do my employer ( changed) need to file a fresh petition under the regular cap ? Or can my old authorization be reinstated in any ways where I would be cap exempted and can file the transfer anytime outside of the cap? Any inputs or ideas would be appreciated Thx.
