Once I have my H4 EAD card, I would like to go ahead and file a divorce. I understand that I will lose my H4 status and the ability to use the related EAD once the divorce is finalized. In this case, can I file I-765 V to request EAD independent of me staying married to my spouse? When is the right time to file this? What is the approval process like?
