Is it legal to stay beyond 240 days for H4 dependents if their primary H1B is approved?

Recommended Posts

I recently got my H1B approved under normal processing at Texas center but my H4 dependents petition is still pending with USCIS Texas center for decision. Since my dependents last petition was valid until Dec 31, 2019, their 240 days grace period is ending on August 27, 2020. I would like to know if my dependents can still stay with me after 240 days since primary H1B is already approved or do they need to travel after completion of 240 days? Please help......

People in any status can stay for as long as their Extension of Stay application is pending, without time limit. This is true for you on H1b, them on H4, or anyone else in any other status. You may be confusing that with the 240-day extension of employment authorization for people getting an extension of work status. There is no extension of employment authorization for your H4 dependents because their status does not by itself authorize them to work.
